While not exhaustive, the following listing identifies the areas of law where the firm's attorneys spend the majority of their time representing both individuals and businesses. Corporate and Business Law: We represent individuals and businesses in the areas of organizational and transactional work for both new and existing business ventures. Our attorneys have extensive experience in business formation and incorporating/forming the business entity, in complex business ventures such as sales and acquisitions, and in litigating business and commercial disputes. Family Law: We practice in all local and regional courts, representing our clients in all areas of family law, including divorce, division of marital property (equitable distribution), custody, child and spousal support, separation agreements, pre-marital agreements, adoptions, paternity, third party parental/visitation rights and interstate child custody. Homeowner's Associations: For twenty-five years, the law firm has represented property owners and property owner's associations, both large and small. Cases involving property owner's associations often involve a unique blend of statutory law and case law involving the areas of contracts, property and corporations. The firm is experienced in both the day-to-day problems that face community associations as well as the special problems that arise when associations make the transition from developer to member control. Litigation: Our attorneys represent the firm's clients in all areas of civil litigation, and regularly appear in the Juvenile and Domestic Relations, General District and Circuit Courts in the City of Charlottesville, Albemarle County, and surrounding jurisdictions. We have handled numerous appeals to the Virginia Court of Appeals and the State Supreme Court. In addition to the Practice Areas specifically noted, in our extensive litigation practice our attorneys litigate cases in numerous other areas such as construction litigation, residential disputes between contractors and homeowners and employment law. Personal Injury Law: We represent persons who have been injured, and the families of persons who have lost their lives, as a result of motor vehicle accidents (cars, trucks/tractor-trailers, pedestrians, bicycles), defective or unsafe products (products liability) or the negligence of some third party, such as premises liability regarding property owners. Our firm's experienced trial attorneys will take your case to trial or, where appropriate, negotiate a settlement of your case directly with the insurance company or pursue alternative means of dispute resolution, such as mediation or arbitration. Real Estate: We represent both buyers and sellers of residential and commercial real estate, as well as owners refinancing their present mortgages. Our attorneys provide representation for several hundred real estate transactions each year. We represent our clients in court when litigation of dispute proves necessary and , in addition, represent our clients before planning commissions, zoning boards and boards of supervisors to obtain approval for proposed commercial and residential projects. Wills, Estate Planning, and Guardianship: The firm's attorneys represent clients in all matters of estate planning, from drafting simple wills, durable powers of attorney and advance medical directives (living wills) to more complex trust and estate planning documents. The firm's attorneys also represent family members in those instances where an elderly person has become incapacitated and a guardian must be appointed, as well as all other occasions where such action is required, as the result of a debilitating accident, condition or disease, or mental retardation.
