Mr Toscano was born in Syracuse, New York, in 1950, the first of five children. He was educated in public schools, received a BA from Colgate University in 1972, a PhD. in Sociology from Boston College in 1979, and his law degree from the University of Virginia in 1986. He has taught at various universities, including Boston College, the University of Maryland (European Division), Piedmont, Virginia Community College, the University of Virginia, and James Madison University. He has been a practising attorney since 1986 and is presently a partner with Buck, Toscano & Tereskerz, Ltd.
Mr Toscano is also a citizen legislator. He has represented the Charlottesville/Albemarle area in the Virginia House of Delegates since 2006, where he serves on the House Courts of Justice, Transportation, and Rules Committees. He is the minority leader in the House. The Virginia legislature generally sits for less than 60 days a year, and Mr Toscano makes it a point to reserve time for his clients and their needs. He previously served on the Charlottesville City Council from 1990 to 2002 and as Mayor from 1994 to 1996. He is a member of the Charlottesville Regional Chamber of Commerce and is a resident of the City of Charlottesville, where he lives with his wife of more than thirty-seven years, Nancy Tramontin, and their son, Matthew.

He is a resident of the City of Charlottesville, where he lives with his wife of more than forty-seven years, Nancy. He is a proud father of his son, Matthew.
